Terms of Service β€” United States

These Terms of Service ("Terms") form a binding agreement between you and HamroRentals ("HamroRentals", "we", "us", "our") and govern your access to and use of HamroRentals' US platform at /us and the us.hamrorentals.com subdomain (collectively, the "Service"). By creating an account, submitting an application or listing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

PLEASE READ CAREFULLY.

Section 14 (Binding Arbitration & Class Action Waiver) requires most disputes to be resolved by individual arbitration and waives your right to a jury trial or class action. You may opt out within 30 days of first accepting these Terms by emailing legal@hamrorentals.com.

1. Eligibility

You must be at least 18 years old and a US resident or lawfully present in the US to use the Service. If you are acting on behalf of an entity, you represent that you are authorized to bind it. The Service is not directed to children under 13, and we do not knowingly collect information from them (see our Privacy Notice).

2. The Service

HamroRentals US is a rental marketplace and tenant/landlord reputation platform. We facilitate listings, rental applications, lease workflows, and a two-way reputation / rental-history score. HamroRentals is not a real estate broker, lender, consumer reporting agency under the FCRA in the strict sense (see Section 7), tax advisor, property manager, or law firm. All rental, leasing, and financial decisions remain solely between landlord and tenant.

3. Fair Housing

HamroRentals complies with the federal Fair Housing Act and applicable state and local fair-housing laws. Landlords and brokers using the Service agree not to discriminate against any applicant or tenant on the basis of race, color, national origin, religion, sex (including sexual orientation and gender identity), familial status, disability, source of income (where protected), or any other protected class. Listings, screening questions, and communications that suggest a discriminatory preference are prohibited and may be removed without notice.

4. Accounts & Acceptable Use

  • Provide accurate, current information; keep your account credentials confidential.
  • You are responsible for all activity under your account.
  • Do not submit false identity, income, employment, rental, or payment information. Misrepresentation on a rental application may constitute fraud under state law.
  • No scraping, reverse engineering, automated probing, security circumvention, spam, or unlawful use.
  • Do not request, collect, or share another person's Social Security number, government ID, bank credentials, or payment card data outside the secure tools we provide.

5. Applications, Screening & Consumer Reports

Tenant applications may include background, credit, eviction, and identity-verification checks performed by third-party consumer reporting agencies. By submitting an application you (i) certify the information is true, (ii) authorize HamroRentals and our screening partners to obtain consumer reports about you under the federal Fair Credit Reporting Act ("FCRA"), and (iii) authorize the landlord identified in your application to receive the results for the limited purpose of evaluating your tenancy. You may request a copy of any report obtained and dispute inaccuracies directly with the reporting agency. Some states (including California, New York, Washington and others) impose additional disclosures, fee caps, and timing rules β€” we will surface those at the point of application where applicable.

6. Application Fees, Security Deposits & Listing Fees

Application fees, security deposits, and other rental charges between you and a landlord are subject to your state and local law (e.g., security-deposit caps, return deadlines, and itemized-deduction requirements). HamroRentals' own platform fees are disclosed on our Pricing page and are paid only to HamroRentals β€” they do not replace or modify any amounts owed to your landlord under your lease.

7. Reputation & Rental-History Score

Our two-way rating and rental-history score reflects landlord- and tenant-reported events (e.g., on-time rent, lease compliance, property condition). HamroRentals is not a "consumer reporting agency" under the FCRA when displaying scores solely between the parties to a tenancy and prospective landlords through our platform; we do not sell these scores to creditors, employers, or insurers. You may request a copy of events recorded about you and dispute inaccuracies by emailing disputes@hamrorentals.com. We will investigate within a commercially reasonable time and correct or remove inaccurate entries.

8. Payments

Payments are processed by Stripe, Inc. By paying, you also accept Stripe's End User Terms. We do not receive or store your full card details. Refunds and cancellations are described in our Refund Policy. Disputes about unauthorized charges should first be raised with us at billing@hamrorentals.com before initiating a chargeback.

9. User Content & License

You retain ownership of listings, photos, messages, and documents you submit ("User Content"). You grant HamroRentals a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display User Content solely to operate and improve the Service. You represent that you have the right to upload your User Content and that it does not infringe any third party's rights.

10. DMCA / Copyright

If you believe content on the Service infringes your copyright, send a notice that complies with 17 U.S.C. Β§ 512(c)(3) to our designated agent at dmca@hamrorentals.com. We will respond to valid notices in accordance with the Digital Millennium Copyright Act and may terminate repeat infringers.

11. Intellectual Property

HamroRentals retains all rights in the platform, software, branding, and scoring methodology. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. No reverse engineering, resale, or circumvention of access controls.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY LISTING, APPLICANT, OR LANDLORD IS ACCURATELY REPRESENTED. Some states do not allow exclusion of certain warranties, so portions of this section may not apply to you.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HAMRORENTALS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID HAMRORENTALS IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR (B) USD $100. Some jurisdictions do not allow these limits; in those jurisdictions our liability is limited to the smallest amount permitted by law.

14. Binding Arbitration & Class Action Waiver

Please read carefully β€” this affects your legal rights. You and HamroRentals agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute") will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court, except that (i) either party may bring an individual action in small-claims court, and (ii) either party may seek injunctive relief in court for intellectual-property misuse. The arbitration will take place in the US county where you reside or, by mutual agreement, by video conference. Each party bears its own attorneys' fees except as otherwise required by law or the AAA rules.

Class Action Waiver. You and HamroRentals agree to bring Disputes only in an individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any class proceeding.

30-Day Opt-Out. You may opt out of this Section 14 by emailing legal@hamrorentals.com within 30 days of first accepting these Terms with the subject line "Arbitration Opt-Out" and your full name and account email. Opting out does not affect any other part of these Terms.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles, except that the Federal Arbitration Act governs Section 14. Subject to Section 14, the state and federal courts located in Delaware will have exclusive jurisdiction for any matter not subject to arbitration. Nothing in these Terms limits your rights under mandatory consumer-protection laws of your state of residence.

16. Suspension & Termination

We may suspend or terminate access for material breach, suspected fraud, non-payment, violation of Fair Housing rules, or other serious or repeated policy violations. On termination, you may request export of your data within 30 days, after which it may be deleted, except where retention is required by law.

17. Indemnification

You will defend, indemnify, and hold harmless HamroRentals from third-party claims and related losses arising from your User Content, your use of the Service, your violation of these Terms, or your violation of applicable law (including Fair Housing, FCRA, and landlord-tenant statutes).

18. Changes

We may update these Terms. Material changes will be communicated by email or in-app notice at least 14 days before they take effect (except where a shorter period is required by law). Continued use after the effective date constitutes acceptance.

FAQ β€” US renters & landlords

I'm a renter β€” what am I agreeing to?

That your application is truthful, that you consent to background and credit checks under the FCRA solely for tenancy evaluation, and that disputes with HamroRentals are resolved by individual arbitration unless you opt out within 30 days.

I'm a landlord β€” what am I agreeing to?

That your listings are accurate and lawful, that you will comply with the Fair Housing Act and state/local source-of-income rules, that you will report rental events honestly, and that you will use applicant data only to evaluate the tenancy.

Does HamroRentals report me to credit bureaus?

No. Our rental-history score is shown to prospective landlords on our platform; we do not sell scores to TransUnion, Equifax, Experian, employers, or insurers.

Can I get a jury trial?

Only if you opt out of arbitration within 30 days (see Section 14) or your claim qualifies for small-claims court.
